TAZEWELL – A Falls Mills man will serve 15 years for a murder that happened in January of 2009.
Randy Miller Howerton, 32, pleaded no contest to murder, shooting into an occupied dwelling house and possession of a firearm by a convicted felon Sept. 1. Howerton was charged in the Jan. 24, 2 009 death of 42-year-old Wesley K. Milam of Kegley, WV.
Police reports from the night of the incident indicate the two men were at Howerton’s residence with several other people. There were reports of drinking and horse play but Howerton was not intoxicated.
Howerton told officers he was practicing his quick draw when he accidentally shot Milam. The trial was delayed while Howerton underwent mental evaluation.
He was ruled competent and was scheduled for a jury trial before deciding to enter his plea. Judge Teresa Chaffin accepted Howerton’s plea and issued a finding of guilt.
Chaffin imposed a total of 46 years on the three charges and suspended 31. She ordered Howerton to be on probation for 10 years once he completes his active sentence.
